Unfortunately, not all immigration applications are accepted. If you received a refusal, removal order from Immigration, Refugees and Citizenship Canada (IRCC), the Immigration and Refugee Board (IRB), or the Canada Border Services Agency (CBSA), you may challenge the decision through an appeal, or judicial review.

Generally speaking, there is no formal appeal process for temporary residence applications (visitor visas, study permits or work permit). However, a refusal may be challenged at the Federal Court through Judicial Review. We will assess the reasons for refusal and determine the best path forward – whether it is reapplying, requesting reconsideration or seeking Judicial Review.

Deadlines for appeals are strict. For most IRCC decisions, you must file an appeal within 15 days if the application was made inside of Canada or within 60 days if the application was made outside of Canada. Appeals at the Immigration Appeal Division must be filed within 30 days of receiving the refusal.
